Please read these Terms of Service ("Terms") carefully. They form a binding agreement between you and the Operator (defined below) governing your access to and use of footballleaguesimulator.com, its subdomains, and the "FLS" / "Football League Simulator" service (collectively, the "Website" or "Service"). By creating an account, or simply by browsing or using the Website, you agree to be bound by these Terms, our Privacy Policy, and, where applicable, our Terms of Sale. If you do not agree, you must stop using the Website immediately.

1. Who We Are

The Website is operated by François Fortier, an individual operating from Sherbrooke, Québec, Canada (the "Operator", "we", "us"). Full publisher and hosting details are available on our Legal Notices page.

2. Eligibility & Account Registration

You must be at least 13 years old to create an account. If the law that applies to you requires a higher minimum age to consent to online services without parental involvement (for example, 16 in some European countries), you must meet that age, or have your parent or legal guardian review and accept these Terms on your behalf and supervise your use of the Service.

When you register, you agree to provide accurate information (username, email address, password), to keep it up to date, and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at contact@footballleaguesimulator.com if you suspect unauthorized access to your account. You may only create and use one account per person, unless we expressly authorize otherwise (for example, to manage a club or league on behalf of a group).

3. Nature of the Service

FLS is a football (soccer) management and match-simulation sandbox provided for entertainment purposes only. Match results, player ratings, statistics, and in-game events are generated by a software simulation engine using randomization and configurable rules; they are fictional, do not reflect real-world sporting events, and must not be relied upon as sports data, betting information, or professional advice of any kind. We do not guarantee that the Service, or any specific feature, will be available at all times, error-free, or uninterrupted.

6. Subscriptions and Payments

The Service is offered under multiple tiers (currently Free, Pro, and Elite), described on our Subscription page. Paid tiers are billed and renewed under the conditions set out in our separate Terms of Sale, which are incorporated into these Terms by reference and govern pricing, billing, auto-renewal, cancellation, and refunds. If a feature, dataset, team, or player exceeds the limits of your current plan (for example, after a downgrade), we may automatically lock the excess content until you upgrade or remove content to fit within your plan's limits; locked content is not deleted solely for this reason.

7. User Content and License Grant

"User Content" means any data, text, names, logos, colors, tactics, or other material you create, upload, or submit to the Website, including custom teams, players, leagues, cups, and datasets. You retain any rights you may have in your User Content. By submitting User Content, you represent that you have the necessary rights to do so and that it does not infringe any third party's rights, and you grant the Operator a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, and display that User Content solely for the purpose of operating, promoting, and improving the Service (for example, displaying your custom team on public league pages, on the community explorer, or in match summaries).

If you make a league, dataset, or team public (through our Community / "Explore" features), other users may view, follow, or simulate matches against it as intended by that feature. You may delete your User Content at any time through the relevant management pages; some data may persist for a limited period afterward for technical or backup reasons, as described in our Privacy Policy.

8. Intellectual Property

Excluding User Content, all content on the Website — including the simulation engine, source code, database structure and schema, configuration files (e.g. events.json, tactics.json), visual design, graphics, and the FLS/FLSim name and logo — is the exclusive property of the Operator or its licensors and is protected by copyright and other intellectual property laws. Except for the limited right to use the Service as intended for personal, non-commercial entertainment purposes, no rights are granted to you by implication or otherwise. Unauthorized reproduction, scraping, redistribution, or reverse-engineering of this content is strictly prohibited.

If you believe content on the Website infringes your copyright, please contact us at contact@footballleaguesimulator.com with a description of the work, its location on the Website, and your contact details, and we will investigate under applicable copyright law (including Canada's notice-and-notice regime under the Copyright Act).

9. Third-Party Services

The Service relies on third-party providers to operate, including Stripe (payment processing), Google reCAPTCHA (bot/fraud protection), Google Analytics and Google AdSense (analytics and, where enabled, advertising), CookieYes (cookie and privacy consent management), and our hosting provider. Your use of the Service may be subject to those providers' own terms and policies. We are not responsible for the availability, content, or practices of third-party services, except as described in our Privacy Policy.

10. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if required to do so by law. Upon termination, your right to use the Service ends immediately; provisions of these Terms that by their nature should survive termination (including Sections 5, 7, 8, 11, 12, 13, and 15) will survive. Termination does not entitle you to a refund except as required by applicable law or expressly stated in our Terms of Sale.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that simulation outcomes will be accurate, balanced, or free of bugs. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

To the maximum extent permitted by the laws of the Province of Québec and the federal laws of Canada applicable therein, in no event will the Operator be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or goodwill, arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages. To the extent liability cannot be excluded, the Operator's total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amount you paid to the Operator for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) CAD $50. Nothing in these Terms limits liability that cannot be limited under applicable law, including for gross negligence, willful misconduct, or death or personal injury caused by our negligence.

13. Indemnification

You agree to indemnify and hold harmless the Operator from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your User Content, or your violation of any applicable law or the rights of a third party, to the extent permitted by applicable law.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service or for legal, regulatory, or operational reasons. We will update the "Last Updated" date above and, for material changes, make reasonable efforts to notify active users (for example, via a notice on the Website or by email). Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights you may have in your place of residence (which these Terms do not limit), any dispute arising out of or relating to these Terms or the Service will be submitted to the exclusive jurisdiction of the courts of the judicial district of the Operator's residence in Québec, Canada.

16. General Provisions

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be a waiver of such right or provision. These Terms, together with our Privacy Policy and Terms of Sale, constitute the entire agreement between you and the Operator regarding the Service and supersede any prior agreements.
